The Power of a Properly Drafted Will

Frequently Asked Questions (Estate Planning)
Can I exclude a legal heir from my Will?
Under Muslim Law, you cannot deprive a legal heir of their mandatory share through a Will. However, under Civil Law or for specific types of assets, certain conditions apply. We guide you on how to handle these complexities legally.
Does a Will need to be registered in Bangladesh?
Registration is not mandatory for a Will but it is highly recommended. A registered Will has higher evidentiary value in court and is much harder to challenge as "forged."
What is the "One-Third Rule" in Muslim Wasiyat?
A Muslim can only Will away 1/3rd of their total estate to anyone who is NOT a legal heir (e.g., a charity or a friend). Anything beyond that requires the consent of all legal heirs after the testator's death.
Can I change my Will after it is signed?
Yes. A Will is a "living" document. You can create a Codicil (amendment) or draft a completely new Will (which automatically revokes the old one) as many times as you want while you are of sound mind.
